EnkatArt — Commission Terms of Service
Last updated: 5 Sep 2026 · Version 1.0Hi! These Terms explain how commissions with me work. Please read them fully before ordering. By sending payment or checking "I have read and agree to the Terms of Service" on my commission form, you enter into a binding agreement with me and accept everything below. (("I"/"me"/"the Artist" = EnkatArt; "you"/"the client" = the person ordering.))
1. Agreement & Acceptance
These Terms are a public offer. You accept them by (a) ticking the agreement box on my commission form and/or (b) paying the invoice/deposit. If you don't agree, please don't order. I may update these Terms at any time; the version in force for your order is the one posted when you ordered.
2. How Ordering Works
Fill out my commission form with clear references and details. A slot is confirmed only after I reply and accept your request and the deposit is paid. I may decline any commission for any reason. I only take on work I can do well, so if your request is outside my style or skills I'll say so.
3. What I Make & AI-Free Guarantee
I create original, hand-drawn anime/manga-style illustration. Every commission is made entirely by me, by hand — I do not use AI image generators at any stage. You are commissioning my style: I can adapt within it, but I can't draw in a completely different artist's style. All work is SFW (safe-for-work) only; I do not take adult/NSFW commissions.
4. Scope & Quotes
Your quote covers the agreed scope (character count, complexity, and whether a background is included). Adding characters, a detailed background, or making major concept changes after we've agreed is re-quoted and may raise the price and timeline. If you need something urgently ahead of my queue, ask about a rush fee — availability isn't guaranteed.
5. Payment & Invoicing
Prices are in USD. Payment is by invoice via Payoneer — I'll send a payment request to your email; please don't send money before I invoice you. I work on a 50/50 basis: 50% up front before I start (the 50% upfront is non-refundable once paid), and the remaining 50% before I send final files. Any payment-processor or bank fees on your side are yours to cover. Final/full-resolution files are delivered only after full payment clears.
6. Refunds
Refunds. Because each commission is custom work reserved and begun on your behalf, the 50% upfront payment is non-refundable once paid — it reserves your slot and covers the work started for you. The remaining 50% is due before final delivery. After final delivery, all sales are final and no refunds are given. Any rush fee is non-refundable. If I am unable to complete your commission for reasons on my side, I will refund the uncompleted portion fairly. In that case, the refund goes to your original payment method where possible, or by bank transfer, within [14] days, in the original invoice currency (USD); processing fees already incurred are non-refundable.
7. Chargebacks
If you have any issue, you must contact me first — most things are easily resolved. Filing a chargeback or payment dispute without contacting me is a breach of these Terms. I will contest it with full documentation (your agreement to these Terms, our correspondence, the invoice, and proof of delivery) and reserve the right to revoke all usage rights and decline future work.
8. Turnaround
My normal turnaround is up to 6 weeks per commission. This is an estimate, not a guarantee — it depends on my queue, the complexity of your piece, and real-life circumstances, including occasional power or connectivity disruptions in my country. The turnaround starts once your payment has cleared on my side, not at the moment you send it. I'll give you a realistic window at the start and keep you updated.
9. Rush Orders
A rush order (+50% of the base price) moves your commission to the front of my queue as my priority and targets delivery in under 2 weeks. Rush is paid 100% upfront and is only available when my priority slot is free. The rush fee is fully non-refundable once work begins, at any stage, because it pays for prioritising your piece and reserving that slot; if you cancel, the rush fee and the upfront payment are non-refundable per Section 6.
10. Revisions
Your commission includes two (2) revision rounds at the sketch stage (pose, composition, expression, design) and one (1) revision round near completion, once the artwork is fully coloured and shaded and the final look is visible — for tone, colour balance, and minor cosmetic fixes within the agreed colour direction. Collect your changes into one message per round. Pose, composition, and design are locked once the sketch is approved; a complete change of colour scheme after that is treated as new work. Because my final colours come together only in the later stages, I don't show flat-colour or intermediate stages as approval points. Any additional round is $40. Corrections of my own mistakes — where I didn't follow the agreed references — are always free and never count as a round.
11. Copyright & Usage License
I retain full copyright to everything I create; copyright is not for sale. You receive a personal-use, non-exclusive, non-transferable license: use the artwork as a profile picture, banner, wallpaper, personal print, and non-monetized posting with credit. You may not resell or redistribute it, use it on merchandise, use it commercially, remove my signature, claim it as your own, use it to train AI/ML models, or mint it as an NFT / use it on any blockchain platform. Commercial rights are a separate add-on license priced as a multiplier of your total: Content / Promotional ×1.5 (monetized content where the art supports but isn't the product — stream overlays, banners, thumbnails, promo posts) and Full Commercial / Merchandising ×3 (where the art is the product — prints, charms, apparel, covers, resale). Commercial/merch licenses are available for original characters you own only. Credit is appreciated for personal use and required for public commercial use.
12. Your Character & References
(a) You warrant that any character, design, or reference you provide is your own creation, licensed to you, or that you are otherwise authorized to commission art of it. You grant me the non-exclusive right to draw it to complete this commission and to display it in my portfolio.(b) Fan-art of characters you don't own is accepted for personal use only. You are solely responsible for how such artwork is used and may not use it commercially; commercial licenses are for original characters only.(c) You agree to indemnify and hold me harmless from any third-party claim (including reasonable costs) alleging that a character, design, or reference you provided — or your use of the finished art — infringes their rights. I hold no responsibility for DMCA or copyright claims resulting from your use of copyrighted characters.
13. What You Receive
Your finished commission is delivered as a high-resolution PNG at 300 DPI (long edge ~3000–4000 px), including a transparent-background version; a JPG copy is available on request. Before final payment you receive a watermarked, web-resolution preview for approval; full-resolution, unwatermarked files are sent once payment clears. Please download and back up your files — I keep finished files for about three (3) months, after which I may no longer have them (re-sends after that, if possible, may incur a small handling fee).
14. Source Files
Layered working files (.psd/.clip) are not included and not for sale. You receive the final flattened artwork in the formats above. Editable/layered files stay with me; this protects my process and prevents unauthorized edits, recolours, or redistribution of my linework.
15. Portfolio & Privacy
By default I may display finished work and WIPs in my portfolio, on social media, and in streams for self-promotion — but I only ever share the artwork itself and never reveal your name or personal details. If you want your commission kept private, a Private Commission/NDA is available for +25% of the base price (calculated on the base, like rush): no public posting, no WIP sharing. In return, please don't publicly reveal I made the piece before any agreed release date.
16. Force Majeure / Circumstances Beyond My Control
I'm based in Ukraine and currently work under wartime conditions. Occasionally this can mean power outages, internet/communication disruptions, air-raid alerts, or other emergencies entirely outside my control that delay a commission. If this happens, I'll notify you as soon as I can; your commission and payments are safe, and I'll resume as soon as conditions allow. Such events (and other force-majeure events like illness or infrastructure failure) extend deadlines and don't make me liable for the delay. Thank you for understanding. 💛
17. Client Delays / Inactivity
I may need your references, approvals, or feedback to continue. If you're unreachable for more than 14 days, I'll pause your commission and move on to other queued work, resuming yours when you return. If there is no contact for 6 months, the commission is considered abandoned and any payments made are forfeit.
18. Your Data
I collect only what I need to complete your commission (contact handle, references, payment info) and keep it no longer than necessary for the project and my accounting duties. I don't sell your data or share your references. If you're an EU/EEA resident, you may request access to or deletion of your personal data, subject to records I must keep by law.
19. Governing Law & Consumer Rights
These Terms are governed by the laws of Ukraine, where I operate as a registered sole proprietor (ФОП). If you are a consumer resident in the EU/EEA, you keep any mandatory consumer-protection rights of your country of residence — nothing here removes those.
20. Dispute Resolution
If something goes wrong, message me first — most things are easily sorted out. If we can't resolve it directly, we agree to try good-faith resolution (including remote mediation if appropriate) before anything else.
21. Conduct
Please be clear and respectful. I reserve the right to cancel (and retain earned payment per Section 6) and to decline future work with clients who are abusive, attempt chargebacks, or break these Terms.By ordering, you confirm you've read and agree to all of the above. Thank you for supporting hand-made art! — EnkatArt
